
What is Cy Pres?
The Cy Pres doctrine (from the Norman French phrase “Cy Pres comme possible,” meaning “as near as possible”) is a court-approved method of distributing funds when the original intended purpose cannot be fulfilled. In class action lawsuits, after class members’ claims have been paid—or when individual damages are too small to distribute—there is often a residual amount that judges and class counsel can direct toward the “next best” use.
