🚨 Urgent Alert: New Decision Strips Immigration 🚨 Urgent Alert: New Decision Strips Immigration Judges of Bond Authority, Threatening Due Process 🚨 

A recent decision by the Board of Immigration Appeals (BIA) severely impacts our immigration system, expanding mandatory detention for countless immigrants by removing judges' authority over bond hearings. This means prolonged confinement and separation from families, often without crucial due process. 

“This ruling represents a serious undermining of decades of legal precedent and a fundamental erosion of judicial independence,” said Sui Chung, Executive Director of Americans for Immigrant Justice. 

Chung added, “This decision will lead to the prolonged and unnecessary detention of countless immigrants, separating them from their families and communities, if they pursue legal claims and defend themselves against deportation.”

Know your rights! “To enter a home, an ICE offi Know your rights!

“To enter a home, an ICE officer would need a valid search warrant signed by a judge—even if they know someone inside is subject to an administrative ICE ‘warrant,’” Paul R. Chavez, Litigation Director at Americans for Immigrant Justice, told Creative Loafing Tampa Bay. 

 “Administrative warrants, issued by ICE itself, do not authorize forced entry into a home, unlike judicial warrants signed by a judge. To enter a home, ICE typically needs either consent or a judicial warrant.”

Praying for justice for immigrants. Father Frank Praying for justice for immigrants. 

Father Frank O’Loughlin, who founded the @guatemalanmayacenter, held mass outside the Everglades Detention Center (“Alligator Alcatraz”) in solidarity with the immigrants detained. 

Hundreds joined Father Frank, including Americans for Immigrant Justice’s Executive Director Sui Chung, AI Justice’s Board Member Peter Upton, Honorary Board Member and filmmaker Ali Codina, and environmental activist and educator Betty Osceola. 

At Americans for Immigrant Justice, we have long worked side-by-side with Father Frank to protect our immigrant communities. In 2019, we had the pleasure of honoring him with our Human Rights Awards.

The ruling to dismantle parts of “Alligator Alca The ruling to dismantle parts of “Alligator Alcatraz” is a major win—but the fight is far from over. We need sustained attention and accountability to ensure no other community becomes the next testing ground for detention sprawl. 

On August 22, we hosted a Senate Hill briefing on the Everglades Detention Camp (“Alligator Alcatraz”)—a facility emblematic of the intersection of immigration injustice, human rights abuse, and environmental destruction. 

We’re grateful to all who attended and engaged. This isn’t just about one facility—it’s about a national trend. 

🏛️ We discussed: 
- Conditions at the Everglades Detention Camp, including inadequate medical care, overflowing toilets, extreme temperatures, and insufficient food. 
- Ongoing litigation (CM v. Noem, Friends of the Everglades v. Noem) 
- A federal court’s injunction halting expansion of the camp 
- Urgent calls for Congressional oversight to prevent replication

Over Labor Day weekend, efforts were underway to d Over Labor Day weekend, efforts were underway to deport dozens of children to Guatemala. Our Children’s Legal Program team—the only provider of legal services in shelters within Miami’s court jurisdiction—immediately mobilized to support the affected children, making contact and ensuring they understood their rights. 

That same weekend, a federal judge temporarily blocked the administration’s efforts. The court affirmed what we witness every day: these children face real danger and are entitled to due process protections. 

This moment underscores why our work is so critical. These children are not statistics, they are young people who fled danger in search of safety, and they deserve legal protections and proper representation. 

Our team works tirelessly to ensure immigrant children know their rights and receive the protections guaranteed under U.S. law. 

We remain steadfast in fighting for every child’s right to due process. #immigration #children #immigrant
