FTW! A federal appeals court decided not to pause FTW! A federal appeals court decided not to pause a lower court’s ruling that stopped Florida’s SB 4-C from being enforced. This law targets undocumented individuals entering the state and has led to multiple arrests, including one involving a U.S. citizen. 

While this ruling is not the end of the fight against this state law, it will prevent state authorities from targeting neighbors across Florida with punishments they would not face under federal law in the meantime.

We are thrilled to welcome Troy Elder, Esq. as Dir We are thrilled to welcome Troy Elder, Esq. as Director of the Detention Program at AI Justice! 

Troy Elder, Esq., brings nearly 25 years of experience in immigration and refugee law to AI Justice, where he will lead efforts to defend the legal rights of detained immigrants. With a background in direct representation, policy advocacy, and legal education, he has dedicated his career to fighting for due process and justice for those facing detention and deportation. 

Immediately prior to joining AI Justice, Troy served as Executive Director of Interfaith Refugee & Immigration Service (IRIS) in Los Angeles, where he expanded legal and social services for refugees, asylum seekers and immigrant families. His work has taken him to the U.S.-Mexico border, courtrooms across the country, and classrooms at leading law schools.  Holding graduate degrees in law and ethics from Yale, Troy speaks Spanish, French, and Haitian Creole, allowing him to communicate directly with diverse immigrant communities. 

Troy takes on this role at a critical moment, as Miami emerges as a key battleground in the fight against unlawful deportations and prolonged immigrant detention. He is committed to ensuring that detained individuals receive legal information and representation, and that AI Justice remains at the forefront of protecting fundamental rights and preserving the rule of law.

Today, we sent BOP and ICE a letter detailing due Today, we sent BOP and ICE a letter detailing due process violations affecting immigrants who are now being held in immigration detention at FDC-Miami, a federal prison.

Our attorneys, alongside attorneys from the American Civil Liberties Union, ACLU of Florida, Florida Legal Services, and the University of Miami Immigration Clinic, have documented troubling systemic failures that prevent detained immigrants from accessing crucial legal resources and communicating with attorneys. These obstacles make it difficult for individuals to understand the charges against them, secure legal counsel, and prepare their immigration cases—violations of ICE and BOP policies, the Administrative Procedure Act, and the U.S. Constitution. 

Due process is a constitutional right guaranteed to both citizens and non-citizens alike, which BOP and ICE must honor.
